The assessor advised that Miss Kelly be detained against her will. Miss Kelly was not keen to go to a unit so she contacted her psychiatrist, Dr. Ramanathan Elayaperumal. He was a Consultant Psychiatrist in the Home Treatment Team at Essex Partnership NHS Foundation Trust.

In response to this recommendation In response to this recommendation Home Treatment Team conducted a thorough assessment of Miss Kelly's state of mind and current functioning. The evaluation included a detailed medical history as well as a physical examination. It also involved a detailed assessment of the psychological and family therapy and a psychiatric diagnostic interview.

According to the report Miss Kelly was afflicted by a range of mental health issues, such as borderline personality disorders such as bulimia, anorexia and bulimia. She also had a history of drug misuse and had been a victim of domestic abuse. Her symptoms were worsened by stress, anxiety, and depression. She was also diagnosed as having bipolar affective and schizoaffective disorders.

Elayaperumal claims that Medtronic intentionally discriminated against him because of his race and national origin. He claims that his poor performance review in June of 2000 as well as the decision not to give him certain projects assignments were motivated by racism. Medtronic has not provided evidence that its decisions were based on these factors. Moreover, Elayaperumal's lower performance review did not result in a reduction in his compensation, benefits, or duties.
