In the end, the assessor recommended that Miss Kelly be held against her will. Miss Kelly didn't want to be in a ward, so she called Dr Ramanathan Elayaperumal, her psychiatrist. He was a consultant psychiatrist at the Home Treatment Team of Essex Partnership NHS Foundation Trust.

In response to the recommendation, the Home Treatment Team performed a comprehensive evaluation on Miss Kelly's present functioning and mental state. The review included a thorough medical history as well as a physical examination. It also involved a detailed assessment of the psychological and family therapy and a psychiatric diagnostic assessment.

According to the report Miss Kelly was afflicted by a range of mental health issues, including borderline personality disorders, bulimia, and anorexia. She also had an history of addiction to drugs and had experienced domestic violence. Depression, anxiety, and stress exacerbated her symptoms. She was also diagnosed with bipolar affective disorder as well as schizophrenia-related disorder.

Elayaperumal claims Medtronic has discriminated against him because of his race or national origin. He claims that his poor performance review in June 2000 and the failure to give him certain project assignments were motivated by racism or national animus. Medtronic has not provided evidence that its decisions were based upon these factors. Elayaperumal's lower performance score did not result in any reduction in his compensation or benefits.
